Terms of Service

These Terms of Service ("Terms") govern your use of the WheelSniffer website (wheelsniffer.in), the WheelSniffer customer app, the WheelSniffer Partner app, our WhatsApp service and any related services (together, the "Platform"), operated by WheelSniffer (a partnership firm), Indore, Madhya Pradesh, India ("WheelSniffer", "we", "us"). By creating an account, posting a requirement, placing a bid or otherwise using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.
1. What WheelSniffer is - and is not
1.1 WheelSniffer is an online technology platform and marketplace. It lets people and businesses who need goods moved ("Customers") post requirements, and lets independent truck owners, fleet operators, drivers, movers and other transport providers ("Transporters") see those requirements, bid and accept jobs.
1.2 WheelSniffer is an intermediary within the meaning of the Information Technology Act, 2000. We are not a transporter, carrier, common carrier, goods transport agent, packer, mover, broker, warehouse or insurer. We do not own, operate, drive or control any vehicle, and we do not take possession of, load, carry, store or deliver any goods.
1.3 When a Customer accepts a Transporter's bid or an instant booking, the contract for the transport, packing, loading, unloading or moving of the goods (the "Transport Contract") is made directly between the Customer and the Transporter. WheelSniffer is not a party to the Transport Contract and is not responsible for its performance.
1.4 Transporters are independent businesses. They are not our employees, agents, partners or representatives, and nothing on the Platform creates any such relationship.
2. Eligibility and accounts
- You must be at least 18 years old and able to enter into a binding contract under Indian law.
- You log in with a mobile number and a one-time password (OTP). You are responsible for all activity on your account and for keeping your phone and OTPs secure. Never share an OTP or your delivery code with anyone except as described in these Terms.
- The information you give us (name, contact details, addresses, business and vehicle details, documents) must be true, complete and up to date. We may suspend accounts that give false information.
- If you use the Platform on behalf of a business, you confirm that you are authorised to bind that business.
3. Prices, bids and payments
- The "fair price" and any estimate shown on the Platform is an indicative figure calculated from general market rates. It is not a quotation, offer or guarantee by WheelSniffer. The price of a job is the bid or fare agreed between the Customer and the Transporter.
- WheelSniffer does not charge Customers a brokerage or commission on the fare. Payments for a job are made by the Customer to the Transporter, either directly or through our payment partner (Razorpay). Tolls, loading/unloading charges, waiting charges, taxes and any extra services are as agreed between the Customer and the Transporter.
- Transporters buy "coins" to place bids and accept instant jobs. Coins are a fee for using the Platform, are non-refundable and have no cash value, except where a refund is required by law or we decide otherwise at our discretion.
- Online payments are processed by Razorpay under its own terms. We do not store your card, UPI or bank details. We are not responsible for failures, delays or errors of banks or payment providers.
4. Customer responsibilities
- Describe your goods, weight, quantity, pickup and drop points, floors and access honestly and completely. Wrong information can change the price, cause delay or make a vehicle unsuitable, and is your responsibility.
- Pack goods properly for road transport, mark fragile items, and remove cash, jewellery, documents and other valuables unless separately agreed in writing with the Transporter.
- Arrange all documents required by law for your goods (for example GST invoice, e-way bill, permits) and pay any applicable taxes.
- Be present, or have an authorised person present, at pickup and delivery. Check the goods at delivery and share your 4-digit delivery code only after you are satisfied that the goods have arrived. Sharing the code confirms delivery.
- Do not book the Platform for any goods listed in section 6.
5. Transporter responsibilities
- Hold and keep valid all licences, registrations and permits required by law, including driving licence, vehicle registration, fitness, pollution and permit certificates, and any goods-carriage or transport-agent registration that applies to you.
- Keep your vehicles roadworthy and insured as required by the Motor Vehicles Act, 1988, and follow all traffic, loading and safety laws.
- Carry goods with due care. The Transporter is responsible to the Customer for loss of, damage to, or delay of goods while they are in the Transporter's custody, as provided by law (including the Carriage by Road Act, 2007 where it applies) and by the Transport Contract.
- Only bid for jobs you can perform with a suitable vehicle, collect only the agreed price, and do not hand over a job to another person without the Customer's consent.
- Documents you upload (GST, PAN, Aadhaar, vehicle details) must be genuine and your own.
6. Prohibited goods and conduct
You must not use the Platform to book, carry or offer to carry: explosives, fireworks, arms and ammunition; narcotics and psychotropic substances; alcohol or tobacco without the required permits; hazardous, flammable, toxic, radioactive or corrosive material (unless carried lawfully in a suitably licensed vehicle and declared in advance); stolen, counterfeit or smuggled goods; live animals or human remains; cash, bullion, precious stones or securities; or anything whose carriage or possession is illegal. You must not harass, threaten or cheat other users, misuse contact details obtained through the Platform, create fake accounts, bids or reviews, or try to interfere with the Platform's security. We may report illegal activity to the authorities.
7. Verification, ratings and information on the Platform
We ask Transporters for documents and may review them, and we show ratings and trip counts given by users. These checks are limited and are not a guarantee of any user's identity, skill, honesty, solvency or behaviour. Ratings, reviews, listings, bids and other content are provided by users and are their responsibility. Use your own judgement before dealing with anyone.
8. Insurance
WheelSniffer does not insure goods. The fare does not include goods-in-transit insurance unless the Transporter expressly agrees. Customers are strongly advised to buy goods-in-transit insurance for valuable goods. Any insurance claim is between you and your insurer or the Transporter.
9. Cancellations and disputes between users
You can cancel a requirement before a bid is accepted. After acceptance, cancellations, refunds, waiting charges and damage claims are matters between the Customer and the Transporter under the Transport Contract. If you raise a complaint, we may, at our discretion, share relevant booking information and help the parties reach a solution, and we may suspend users who break these Terms, but we are not obliged to resolve the dispute or to pay any amount.
10. Limitation of liability
10.1 The Platform is provided "as is" and "as available". To the maximum extent permitted by law, we give no warranty that the Platform will be uninterrupted, error-free or that any Transporter or Customer will be available, suitable or perform as agreed.
10.2 To the maximum extent permitted by applicable law, WheelSniffer and its owners, employees and partners are not liable for: (a) any loss of, damage to, shortage in, theft of, delay or misdelivery of goods; (b) any injury, death, accident or damage to property arising from any job; (c) any act, omission, negligence, misconduct or default of any Customer, Transporter, driver or other third party; (d) any indirect, incidental, special or consequential loss, or loss of profit, business, goodwill or data; or (e) anything outside our reasonable control (see section 12).
10.3 If, despite the above, WheelSniffer is found liable to you for any reason, our total liability for all claims relating to the Platform shall not exceed the fees you paid to WheelSniffer (for example, coins purchased) in the three months before the event giving rise to the claim, or ₹1,000 if you paid us no fees.
10.4 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
11. Indemnity
You agree to indemnify and hold harmless WheelSniffer, its owners, employees and partners from any claim, demand, loss, penalty, cost or expense (including reasonable legal fees) made by any third party or authority arising out of: your use of the Platform; the goods you book or carry; your breach of these Terms or of any law; or any dispute between you and another user.
12. Events beyond our control
We are not responsible for any failure or delay caused by events beyond our reasonable control, including natural disasters, weather, accidents, strikes, road or traffic restrictions, government orders, epidemics, internet, telecom, SMS or payment outages, or failures of third-party services such as maps, messaging and hosting providers.
13. Suspension and termination
We may suspend, restrict or close any account, remove any requirement, bid or content, or refuse service, with or without notice, if we reasonably believe that these Terms or the law have been broken, or to protect users or the Platform. You can delete your account at any time from the app or at https://wheelsniffer.in/v2/delete-account. Sections 3, 7 to 12 and 14 continue to apply after your account ends.
14. Intellectual property and acceptable use
The Platform, its software, design, logos and content belong to WheelSniffer or its licensors. You may use the Platform only for its intended purpose. You must not copy, scrape, resell or reverse-engineer it, or use automated means to access it, without our written permission.
15. Governing law and disputes
15.1 These Terms are governed by the laws of India.
15.2 Before starting any legal proceedings, please contact our Grievance Officer (section 17) and allow us 30 days to try to resolve the matter.
15.3 Any dispute with WheelSniffer arising out of or in connection with these Terms or the Platform that is not resolved in that way shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement of the parties (or, failing agreement, as provided in that Act). The seat and venue of arbitration shall be Indore, Madhya Pradesh, and the language shall be English.
15.4 Subject to section 15.3, the courts at Indore, Madhya Pradesh shall have exclusive jurisdiction.
16. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "last updated" date, and for important changes we may also notify you in the app. Continuing to use the Platform after the change means you accept it.
